Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the DXE Brakes website and your purchase of any products from DXE Brakes ("we," "us," "our"), including e-moto and e-bike brakes, footbrakes, and brake accessories (the "Products"). By placing an order or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services or purchase our Products.

Nature of Products, Safety-Critical Components

You acknowledge and agree that:

Footbrakes and other braking components are safety-critical parts. Improper selection, installation, adjustment, maintenance, or use of these Products can result in brake failure, loss of vehicle control, serious injury, or death.

DXE Brakes sells Products as parts only. We do not install, fit, adjust, or inspect any Product on your vehicle, and we have no ability to control or verify how a Product is installed or maintained after it leaves us.

You are solely responsible for ensuring that any Product is installed, adjusted, tested, and maintained by a qualified, competent person (such as a licensed mechanic or qualified bicycle/e-moto technician) in accordance with the manufacturer's instructions and all applicable safety standards, before the vehicle is ridden.

You must not ride, operate, or permit any other person to ride or operate a vehicle fitted with a Product unless the brake system has been correctly installed and tested by a qualified person.

Assumption of Risk

Riding any bicycle, e-bike, or e-moto carries inherent risk, and that risk is materially affected by the condition, installation, and maintenance of the braking system. By purchasing and/or using a Product, you voluntarily assume all risks associated with the selection, installation, condition, and use of that Product, to the maximum extent permitted by law.

Your Responsibilities

You agree that you will:

Have the Product installed and inspected by a qualified person before use;

Follow all manufacturer instructions, torque specifications, and maintenance schedules;

Regularly inspect the Product for wear and have it serviced as needed;

Not use the Product for any purpose other than that for which it was designed;

Not modify the Product in a way not authorized by the manufacturer; and

Immediately stop using the Product and seek qualified inspection if you notice any unusual noise, feel, or performance from the brakes.

Limitation of Liability

To the maximum extent permitted by applicable law:

DXE Brakes' total liability arising out of or relating to any Product or the Services — whether in contract, tort (including negligence), statute, or otherwise — is limited, at our option, to the repair or replacement of the Product, or a refund of the amount you paid for it.

DXE Brakes will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of vehicle, loss of income, or loss arising from installation, adjustment, or maintenance performed by you or any third party.

Nothing in these Terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified, including guarantees available to you under the Australian Consumer Law (or equivalent consumer protection law in your jurisdiction) in respect of goods that are not of acceptable quality, not fit for purpose, or not as described. Where such a guarantee applies and cannot be excluded, our liability is limited (where the law permits) to the options set out above.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited as a matter of law.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless DXE Brakes, its officers, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal costs) arising out of or in connection with:

Your installation, adjustment, or maintenance of a Product (or that performed by a third party on your behalf);

Your failure to have a Product installed or inspected by a qualified person;

Any modification or misuse of a Product; or

Your breach of these Terms.

This indemnity does not apply to the extent a claim arises from our negligence or from a defect in the Product as sold, to the extent such liability cannot lawfully be excluded.

Product Warranty

Products are covered by any warranty stated on the product page or provided by the manufacturer at the time of purchase, in addition to any non-excludable statutory guarantees. Except as stated above, and to the extent permitted by law, Products are supplied without any other warranty, express or implied.

Orders, Cancellations, and Refunds

Orders are fully cancellable and refundable up until the order has been processed. Order processing takes 12–24 hours from the time the order is placed.

Once an order has been processed, it is final and cannot be cancelled, modified, or refunded for change of mind, incorrect part ordered, or shipping delays, regardless of shipping status — except where required by law (for example, statutory guarantees for faulty or not-as-described goods under the Australian Consumer Law).

It is your responsibility to contact us within the 12–24 hour processing window if you wish to cancel or amend an order.

Intellectual Property

All content on the Services, including text, graphics, logos, and images, is owned by or licensed to DXE Brakes and may not be used without our prior written consent.

Third-Party Links

The Services may link to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party site.

Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted on this page with an updated "Last updated" date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. You submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
